Canada: Easing health restrictions for vaccinated travelers

 The Canadian government has announced the details of the first phase of a plan to ease restrictions imposed on travelers returning to the country.

From midnight on July 5-6, travelers entitled to enter Canada (new window), who have completed the vaccination process, will be exempted from quarantine

And from the test to detect the emerging corona virus 8 days after their arrival in Canada, as stated in a statement issued by the government.

Vaccination is considered complete when, 14 days before arrival, a person receives all doses of the vaccine, or a combination of several doses of several vaccines, approved by the Canadian authorities.

The prudent measures announced today were only possible thanks to the remarkable efforts of Canadians, and further modifications are possible if we continue to protect each other.

The Pfizer-Biontech, Moderna, AstraZeneca, and Johnson & Johnson vaccines have been approved by the Canadian health authorities.

In its statement, the government clarified that it is possible to receive the vaccine in any country (new window), and the traveler must present a document proving that he has received the vaccine, with a French or English copy, or a copy translated by an accredited translator.

He also still has to take a virus test 72 hours before the flight, submit health information via ArrivCan, and prepare a quarantine plan if they test positive for the virus upon arrival in Canada.

Virus tests allow public health experts to continue to monitor the percentage of positive results of tests conducted at the borders, monitor cases associated with virus variants, and make the necessary adjustments, as the Ministry of Health has clarified.

The imposed health procedures remain mandatory for returning travelers, including putting a muzzle in public places and keeping for 14 days the documents they submitted upon arrival, as well as a list of the people they contacted.

The current quarantine procedures remain in effect for travelers who have not completed the vaccination.

It is noteworthy that the Canadian government is under more pressure to reopen the borders.

All supporting documents must be completed as stated in the document checklist on the IRCC website relevant to the visa category requested. If you are unable to provide all of the supporting documents mentioned in the referenced IRCC official checklist, you must complete, sign and attach the waiver form with your visa application form.

You must read the Privacy Policy, complete the consent form and attach it to your visa application form. If you fail to attach the completed and signed consent form with your application, our staff will not be able to assist you, and the application will be returned to you.

Is it possible to apply for asylum in a country from outside it?

Many wonder if one can apply for asylum in a country without being on its territory, is that practical? What about refugee resettlement, how is this done?

Although a person must be present in the territory of the country in which they are seeking asylum in order for their asylum claim to be determined, that person may be “resettled” when they are in a third country (other than their home country and other than the country in which they are resettled).
According to Article 1 of the 1951 Geneva Refugee Convention, a refugee is a person who is outside his country of nationality or habitual residence (for a stateless person) “because of a well-founded fear of being persecuted because of his race, religion, nationality, membership of a particular social group or opinions.” political person, outside the country of his nationality, and is unable, or does not want because of that fear, to seek the protection of that country, or every person who does not have a nationality and is outside the country of his previous habitual residence as a result of such events and is unable, or does not want because of that fear, to return to that country."
By definition in the Convention, refugee status does not apply to a person who continues to live in their home country, even if they are suffering from persecution. Therefore, he cannot submit an application for asylum to any country while he is there, and it is not possible to submit an application for asylum to any embassy or diplomatic mission of a country.
According to the official website of the United Nations High Commissioner for Refugees, the status of a refugee does not even include internally displaced persons, even if they are fleeing for reasons similar to the reasons for the refugee’s flight, due to the spatial difference between them. As refugees, according to UNHCR, are people who have crossed an international border to a second country in search of safety, while the displaced remain in their own country and thus remain subject to the laws of that country.

Asylum centers outside Europe?
In Germany, for example, Interior Minister Thomas Demeziere has called several times for the establishment of centers in transit countries in North Africa, where asylum applications can be submitted and decided upon, which will reduce the large number of people heading to Europe. Proponents of this idea believe that the establishment of these centers could save the lives of thousands of people who would risk their lives on often dangerous journeys to reach a "European paradise" in which their applications may be rejected in the first place. One of the advantages of this is that a common European system is developed to deal with asylum issues outside the borders of the European Union, in addition to rehabilitating staff, raising the efficiency of expertise and developing infrastructure that may be a solution to the non-recurrence of millions of refugee waves.

On the other hand, this idea collides with many legal and humanitarian obstacles, perhaps the most important of which is the possibility of violating the right that provides for freedom of asylum in any country to escape persecution in the Universal Declaration of Human Rights. In addition, there are reports that question the democracy of those countries in which asylum centers are planned to be established. This is in addition to the lack of experience in the field of asylum and the reception capabilities of infrastructure and others in the countries in which asylum centers can be established. Despite this, ideas and suggestions are still continuing to avoid the policy of open doors for refugees that led to political changes in Europe.

Despite this, member states do not always adhere strictly to this rule. With so-called "automatic entry" they can decide on the asylum procedure for the immigrant, even if he or she has initially entered another EU country. For example, Germany suspended the Dublin Agreement several times and refused to deport refugees to other countries.

Border control procedures in the Schengen area

The Schengen area does not cover the entire European Union. Because not all EU countries are members of the Schengen area (eg Bulgaria and Romania), but some non-EU countries (eg Iceland and Norway) are associate members of the Schengen area. Within this area people can generally move, as there are no border controls. However, this rule is not always applied. During the refugee crisis, Germany introduced border control measures in the "Schengen agreement" area in 2015 to prevent a large number of refugees from entering Germany without reviewing their papers. However, border controls were allowed for a short period and in emergency situations, but Germany extended them several times, most recently in November 2017. تعد سياسة اللجوء حالياً واحدة من أكبر نقاط الخلاف بين أطراف الائتلاف الحكومي في ألمانيا. وهكذا فلكل من الحزب الديموقراطي المسيحي  والاتحاد المسيحي الاجتماعي البافاري والحزب الاشتراكي الديموقراطي آراء مختلفة حول عدد اللاجئين المسموح لهم بدخول البلاد وتوقيت استقبالهم  وطريقة التعامل مع طلبات اللجوء. ولكن ما هي القواعد التي يجب على الجميع الالتزام بها، ليس فقط في ألمانيا، بل في جميع أنحاء الاتحاد الأوروبي؟ إن لوائح الاتحاد الأوروبي التي تم اعتمادها بشأن سياسة اللجوء، وأيضًا بشأن قضايا أخرى، تنطبق بشكل واضح على جميع الدول الأعضاء. لكن كيفية تأويل كل بلد لهذه اللوائح وتحويلها إلى قانون وطني يقع على عاتق كل دولة عضو في الاتحاد. ولهذا السبب لا تزال هناك اختلافات كبيرة بين الدول الأعضاء في الاتحاد الأوروبي حول بعض النقاط.

إيواء اللاجئين

  3. وعليه أن يمتلك خبرة في العمل وذلك بدوام كامل، أو يمتلك من الخبرة العملية ما هو بدوام جزئي
  4. أما فيما يخص متطلبات العمل كحرفي ماهر، يتم تحديدها في تصنيف المهن الوطنية.
  • تم برنامج فئة الخبرة الكندية Canadian Experience Class، حيث يتعيّن علي المتقدم استيفاء الشروط والمعايير التالية:
  1. أن يمتلك ما لا يقلّ عن 12 شهر من الخبرة العملية بدوام كامل في كندا خلال الأعوام الثلاثة الماضية.
  2.  أو يكون حاصل على ما يعادل المدة السابقة من الخبرة العملية، بدوام جزئي،
  3. كما أنّه لا يتمّ احتساب خبرة العمل الحرّ، أو الخبرة المكتسبة أثناء الدراسة.
  4. وأن يستوفي جميع والقوانين المطلوبة المطلوبة للوظيفة، الاستماع و القراءة  والكتابة.
  5. كما يجب أن يكون عازمًا على العيش خارج منطقة الكيبيك.
  • وهناك البرنامج  الفدرالي الموجة للطبقة العاملة المؤهلة Federal Skilled Worker Program.، حيث يعتمد على النقاط التالية :
  1. على التعليم الذي يعطي 25 نقطة.
